By accessing or using the services provided by FlowState ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. SERVICES PROVIDED

FlowState specializes in web development, design, and hosting services. We offer standardized packages (Kickstarter, Standard) and custom builds. Our services include:

• Website design and development.
• Hosting and maintenance.
• Technical SEO setup.
• Domain connection assistance.

2. PAYMENTS AND FEES

Package Pricing: Prices for our packages are clearly listed on our website. We reserve the right to update pricing at any time, but changes will not affect active quotes or ongoing projects.

Payment Structure:

• Development Fee: A 50% non-refundable deposit is required to commence work. The remaining 50% is due upon project completion and before the site goes live.
• Hosting Fee: Monthly hosting fees (e.g., R50/mo or R90/mo) are billed via debit order or recurring invoice. Failure to pay hosting fees may result in the suspension of your website.

3. CLIENT RESPONSIBILITIES

To ensure a smooth process, you agree to provide:

• All necessary text content, images, and branding assets (logos, fonts) in a timely manner.
• Feedback and approvals within 5 business days of receiving drafts.
• Access to necessary accounts (e.g., domain registrar) if required.

4. INTELLECTUAL PROPERTY

Your Content: You retain full ownership of all content (text, images, logos) you provide to us.

Our Work: Upon full payment of the Development Fee, FlowState grants you full ownership of the final website code and design. We reserve the right to display the project in our portfolio and marketing materials.

5. TIMELINES AND DELIVERY

We strive to meet all estimated timelines (e.g., "Ready in 72 Hours" for Kickstarters). However, timelines are dependent on your timely provision of content and feedback. We are not responsible for delays caused by third parties or late client submissions.

6. LIMITATION OF LIABILITY

FlowState is not liable for any indirect, special, or consequential damages arising out of the use of our services. This includes, but is not limited to, loss of data, loss of profits, or service interruptions caused by third-party hosting providers or domain registrars.

7. TERMINATION

Either party may terminate the agreement with written notice. If you terminate the project after work has commenced, the 50% deposit is non-refundable. If we terminate the project for reasons other than your breach of contract, we will refund any unearned fees.

8. GOVERNING LAW

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms will be subject to the jurisdiction of the courts in South Africa.
